Definitions
For the purposes of these Terms:
- Platform: the website, application and services offered by Wedinest.
- User: any natural or legal person who accesses or uses the Platform.
- Account: profile created by the User to access the services.
- User Content: any information, file, image or content incorporated by the User.
- Third-Party Data: information relating to guests, attendees, suppliers or other persons incorporated by the User.
- Plan: access or subscription option offered by Wedinest.
- Subscription: contracting of any of the paid plans offered by Wedinest.
Minimum age
The user must be at least 18 years old or have sufficient legal capacity to enter into a contract.
User responsibilities
The user is responsible for maintaining the confidentiality of their access credentials.
Any activity carried out from an account shall be deemed to have been performed by its holder.
The user must notify Wedinest of any unauthorised access, loss of credentials or security incident of which they become aware.
Wedinest may adopt additional security measures when necessary to protect the platform or its users.
Third-party data
Users shall be responsible for the data of guests, suppliers or other persons incorporated into the platform, as well as for ensuring that they have sufficient legitimacy for its incorporation and processing in accordance with applicable regulations.
Access by third parties invited by the user
Certain platform features may allow wedding planners to grant access to couples, collaborators or other persons related to an event.
The user who creates and manages the event shall be considered the main party responsible for the workspace associated with that event, for the management of such access and for the information incorporated by the persons invited to their workspace.
Wedding planners who use the platform on behalf of their clients shall be responsible for ensuring that they have sufficient authorisation to incorporate the information and content related to the events managed.
Features
Guest management and RSVP
Wedinest provides tools intended for guest management, attendance confirmations (RSVP) and the collection of information related to the events organised by users.
The accuracy, currency and truthfulness of the information provided by guests or third parties is the exclusive responsibility of the users.
Wedinest does not guarantee the actual attendance of guests nor the accuracy of the responses obtained through forms or RSVP systems.
Dietary restrictions, allergies and intolerances
Wedinest provides tools intended to record, organise and display information provided by users regarding dietary restrictions, allergies, intolerances or dietary preferences.
Users are solely responsible for:
- The accuracy and currency of such information.
- Obtaining the necessary consents or authorisations.
- The effective communication of such information to suppliers, venues, caterers and third parties involved in the event.
Wedinest does not provide medical, health, nutritional or food-safety services.
Wedinest acts exclusively as a tool for organising and managing information provided by users.
Wedinest does not guarantee that the information stored on the platform will be communicated, interpreted or applied correctly by the suppliers participating in the event.
Use of the platform does not replace the obligation to verify directly with the relevant suppliers.
Seating Plan
The seating plan features are exclusively organisational and visual in nature.
Wedinest does not guarantee the suitability of the proposed arrangements nor assumes responsibility for conflicts, incidents or organisational decisions arising from the assignment of tables or guest locations.
Wedding website
Users may publish web pages or publicly accessible content through the platform.
The user is solely responsible for the published content, including texts, images, links, forms and information relating to the event.
Wedinest may remove content that is unlawful, infringes third-party rights or breaches these terms.
Acceptable use
The user undertakes to use Wedinest in accordance with applicable law, these terms and the basic standards of good faith and reasonable use of the platform.
The following is prohibited:
- Using the platform for unlawful, fraudulent or activities contrary to applicable regulations.
- Entering false or misleading information or information that infringes third-party rights.
- Incorporating content that infringes intellectual property rights, image rights, privacy or other legally protected rights.
- Attempting to access without authorisation the accounts, data, systems or features of other users.
- Introducing viruses, malware, malicious code or any element that could compromise the security or functioning of the platform.
- Using the platform in a way that could negatively affect its availability, performance or security.
- Carrying out reverse engineering, decompilation, automated data extraction or any attempt to gain access to the source code or internal workings of the platform, unless applicable law expressly permits it.
Wedinest may suspend or limit access to the platform when there are reasonable indications of a breach of these usage rules.
Subscriptions
Automatic renewal
Paid subscriptions will renew automatically at the end of each contracted billing period, unless the user cancels the renewal before the corresponding date.
Automatic renewal allows uninterrupted access to the features associated with the contracted plan to be maintained.
Billing
Subscriptions may be contracted under the billing methods that Wedinest offers at any given time.
The prices, characteristics, features, limitations and conditions applicable to each plan shall be those in force at any given time and may be communicated through the platform, during the contracting process or through any other channel enabled by Wedinest.
Wedinest may update such conditions when necessary for technical, operational, commercial or legal reasons.
Cancellation
The user may cancel their subscription at any time through the features enabled on the platform or through the contact channels provided by Wedinest.
Cancellation will prevent the automatic renewal of the subscription at the end of the period already paid for.
The user will retain access to the features of their plan until the end of that period.
Plan changes
Wedinest may allow switching between different available plans.
The conditions, effects and application date of plan changes may vary depending on the type of subscription contracted and will be communicated to the user at the time of making the change.
Payment failures
When a payment cannot be processed due to issues related to the payment method used, incorrect billing data, insufficient funds or other similar circumstances, Wedinest may ask the user to update the information necessary to complete the charge.
Suspension for non-payment
In the event of non-payment, Wedinest may temporarily limit access to certain features or suspend access to the platform until the situation is resolved.
Suspension for non-payment shall not extinguish the user's outstanding financial obligations.
Refunds
Unless applicable regulations expressly provide otherwise, amounts paid shall not be refundable once the corresponding subscription period has started.
Cancellation of a subscription shall only prevent its future renewal and shall not give rise to a total or partial refund of periods already started.
Changes to plans and prices
Wedinest may modify the prices, features, limits or characteristics of the plans offered.
When such modifications affect active subscriptions, the user will be informed with reasonable notice before they take effect.
Termination
Upon termination of a subscription or cancellation of an account:
- Access to the platform and its features may be blocked or limited in accordance with the applicable plan.
- Data may be retained for a maximum period of 90 days for operational and security reasons, compliance with legal obligations or handling possible incidents.
- After that period, data may be permanently deleted or anonymised.
- Once definitively deleted, data cannot be recovered.
- The foregoing is without prejudice to data that must be retained for a longer period due to a legal obligation.
Export
Wedinest may offer features for exporting certain data or content. The availability, format and scope of such features may change at any time.
Availability
Wedinest will make reasonable efforts to maintain the availability of the service, with temporary interruptions possible due to maintenance, technical incidents, updates or causes beyond Wedinest's reasonable control.
Likewise, certain platform features depend on services provided by third parties. Wedinest shall not be liable for interruptions, delays or incidents arising from the functioning of such external providers.
Although Wedinest adopts reasonable measures to protect the stored information, users are responsible for keeping backups of any content they consider essential.
Limitation of liability
Wedinest shall not be liable for indirect losses, loss of profit, business interruptions, decisions taken by users or technical incidents that are reasonably unforeseeable or beyond Wedinest's control.
Under no circumstances shall Wedinest be liable for personal injury, allergic reactions, food incidents, catering errors or any other consequence arising from:
- Incorrect or incomplete information provided by users.
- Failure to update the information.
- Communication errors between event participants.
- Acts or omissions of suppliers or third parties.
Financial limitation of liability
To the maximum extent permitted by applicable law, Wedinest's total accumulated liability arising from the use of the platform shall be limited to the amount actually paid by the user during the twelve months prior to the event giving rise to the claim.
This limitation shall not apply where current law expressly provides otherwise.
Suspension and cancellation of accounts
Wedinest may suspend, limit or cancel access to the platform when there are reasonable indications of fraudulent use, breach of these terms, unlawful use of the services or any action that could affect the security, integrity or functioning of the platform or of third parties.
The suspension or cancellation of an account shall not give rise to any refund unless applicable regulations provide otherwise.
Service modifications
Wedinest may modify, update, expand, limit or remove platform features when necessary for technical, operational, commercial or legal reasons.
These modifications shall not give rise to any right to compensation unless legal provision states otherwise.
Images and copyright
The user guarantees that they hold the rights, licences or authorisations necessary for all content incorporated into the platform.
The user shall be responsible for any claim arising from infringements of intellectual property, image rights or third-party rights.
Ownership of content
Users retain ownership of the data, documents, images and other content they incorporate into the platform.
Wedinest does not acquire ownership rights over such content beyond what is strictly necessary to provide the services offered.
The user grants Wedinest a limited authorisation to store, process and display such content to the extent necessary for the functioning of the platform.
Intellectual property
All intellectual and industrial property rights over Wedinest, including its software, design, databases, graphic elements, documentation, trademarks and content, belong to their respective owners.
Use of the platform does not imply the assignment of any intellectual property right to the user.
Discontinuation of the service
Wedinest may suspend or terminate, in whole or in part, the provision of its services for technical, operational, economic, legal or business reasons.
Whenever reasonably possible, Wedinest will endeavour to inform affected users in advance.
Termination of the service may entail the loss of access to the platform and the subsequent deletion of stored data once the applicable retention periods have elapsed.
Modification of the terms
Wedinest may modify these Terms and Conditions when necessary for legal, technical, operational or commercial reasons.
The current version will always be available on the platform or on the corresponding website.
